Terms and Conditions for the Fiberlogy Store

  1. Chapter 1. General Provisions, Contact with the Store Owner
    1. These Terms and Conditions (hereinafter referred to as the "Terms") define the rules and conditions for using the Fiberlogy online store, operating at https://fiberlogy.com.
    2. The owner of the Store is Fiberlab S.A., with its registered office at: Brzezie 387, 32-014 Brzezie, Poland, entered into the Register of Entrepreneurs of the National Court Register under KRS number: 0000533098, VAT: PL6772384498, REGON: 360-151-591 (hereinafter the "Seller").
    3. The Seller's contact details are as follows:

      Phone number: +48 530 100 605 (customer service hours – see the "Contact" section).
      Point of contact for communication with EU Member State authorities, the European Commission, and the Digital Services Board: shop@fiberlogy.com. Communication can be conducted in Polish and English.
    4. These Terms include:
      1. information about the electronic commerce service offered and provided by the Seller, which enables customers to purchase goods and digital content or digital services online (i.e., remotely) via the Store ("Store Service");
      2. the necessary information for using the above service.
  2. Chapter 2.Technical Requirements
    1. To use the Store, it is necessary to have:
      1. a computer or other device with an internet browser;
      2. access to the Internet;
      3. an active email address.
  3. Chapter 3.Personal Data
    1. The administrator of the personal data of the Store's customers is the Seller.
    2. All information regarding the processing of personal data of customers and other users of the Store's website can be found in the Privacy Policy.
  4. Chapter 4.Conclusion of the Sales Agreement, Customer Account
    1. The Store allows the purchase of goods (hereinafter "Products") displayed on the website in two modes:
      1. without registration;
      2. by creating an account in the Store.
      In both cases, to place an order, the customer selects Products, adds them to the "Cart", and proceeds with the order process by selecting delivery and payment options.
    2. Product information, including descriptions and prices, constitutes an invitation to conclude a sales agreement within the meaning of Article 71 of the Polish Civil Code.
    3. To place an order, the customer must complete all required data, including invoice details if needed.
    4. Creating an account (the "Account") is a one-time process. Login requires an email address and password. Details of this service are available in the Account Terms. The Account allows access to order history and facilitates future purchases.
    5. The customer may cancel their Account at any time and at no cost by sending an email to shop@fiberlogy.com.
    6. Clicking the "Buy and Pay" button signifies:
      1. submitting an offer to purchase Products based on the selected options and these Terms;
      2. accepting the obligation to pay for the Products and their delivery.
    7. The sales agreement (hereinafter referred to as the "Agreement") is formed when the Seller accepts the order for fulfillment (acceptance of the customer's offer). The Seller confirms this by sending an email with an order confirmation.
    8. If it is not possible to fulfill the order for the Products (in whole or in part), the Seller will notify the customer - in such a case, the Agreement is not concluded. The Seller will also inform the customer of any available alternatives for order fulfillment, such as partial delivery or waiting for the Seller to restock. If the order was prepaid by the customer but cannot be fulfilled, the Seller will immediately refund the payment (in proportion to the canceled part of the order).
    9. The Seller provides confirmation of the Agreement on a durable medium no later than at the time of delivery.
    10. The Seller shall not be liable for the non-delivery or delayed delivery of an order resulting from the customer providing an incomplete/incorrect delivery address or failing to provide other necessary order details.
    11. The Seller reserves the right to suspend order fulfillment if the customer has provided false information or if the provided data raises justified doubts regarding its accuracy. In such cases, the Seller (when possible) will attempt to contact the customer to verify the authenticity of the submitted details.
  5. Chapter 5.Prices and Payment Methods
    1. Product prices are quoted in Polish zloty (PLN) and include VAT (gross prices).
    2. Delivery costs are shown separately in the cart and depend on the chosen delivery method.
    3. Available payment methods are described on the Store’s website in the "Payment Methods" section and are shown during checkout.
    4. The Store offers the following payment methods:
      1. traditional bank transfer to the Seller’s account,
      2. instant bank transfer / BLIK / digital wallet payments via:
        • Shoper Płatności (Autopay)
        • PayPal
        • Przelewy24
        • Stripe
      3. card payment: Visa, Visa Electron, MasterCard, MasterCard Electronic.
    5. If the customer chooses bank transfer, payment must be made within 5 days of placing the order. If payment is not received within this time, the Agreement is considered not concluded (unless deferred or installment payment applies).
    6. For payments made via Shoper Payments, the payment operator is Autopay S.A.
    7. For payments made via Stripe, the payment operators are Stripe Payments Europe, Limited and Stripe Technology Europe, Limited (Ireland). Terms of integration are defined in the Stripe Integration Terms for Shoper Stores https://www.shoper.pl/static/regulaminy/uslugi-finansowe-i-platnosci/regulamin-uslugi-integracji-stripe-w-sklepie-internetowym-shoper-od-2025-03-15.pdf. Consumer Stripe terms are available at: https://stripe.com/en-pl/legal/consumer.
  6. Chapter 6.Delivery of Products
    1. Products are delivered based on the customer's choice:
      • via courier service
      • to InPost parcel lockers
    2. Except for personal pickup, the order is considered fulfilled when the shipment is handed over to the carrier. Delivery times are determined by the carrier.
    3. Products are dispatched within 7 business days unless a different delivery time is specified in the product description. Details are provided in the "Order Fulfillment Time" section.
    4. Orders are fulfilled within Poland in accordance with delivery costs listed in the "Delivery Time and Costs" section. International shipping is available either at the rates shown on the website or as individually agreed with the customer.
  7. Chapter 7. Right of Withdrawal
    1. A Consumer or a Privileged Entrepreneur has the right to withdraw from the sales agreement for the Goods within 14 days of receiving them, without providing a reason, subject to certain exceptions.
    2. To meet the withdrawal deadline, it is sufficient for the customer to send a withdrawal declaration within this period:
      • by email: shop@fiberlogy.com lub
      • by mail: Brzezie 387, 32-014 Brzezie, Poland.
    3. The withdrawal declaration may be submitted using the standard withdrawal form - Download form template. Use of this template is optional. The Seller will promptly send the customer an email confirmation of receipt of the withdrawal declaration.
    4. Subsequently, within 14 days of submitting the withdrawal declaration, the customer must return the Goods at their own expense to the following address: Brzezie 387, 32-014 Brzezie, Poland.
    5. The Seller will refund the customer without undue delay, and no later than 14 days from receiving the withdrawal declaration:
      • The price of the Products;
      • The original shipping costs (based on the cheapest standard delivery method offered by the Store).
    6. The Seller may withhold the refund until the Products are received back or until the customer provides proof of return.
    7. The refund will be processed using the same payment method as in the original transaction, unless the customer explicitly agrees to an alternative method.
    8. The customer is liable for any diminished value of the returned Products if, prior to submitting the withdrawal declaration, they used the Goods in a manner beyond what is necessary to determine their nature, characteristics, and functioning.
  8. Chapter 8.Exceptions to the Right of Withdrawal
    1. The right to withdraw from the sales agreement does not apply to contracts for the delivery of Products that:
      1. are non-prefabricated and manufactured according to the consumer’s or Privileged Entrepreneur’s specifications, or intended to meet their individual needs (customized products);
      2. are liable to deteriorate rapidly or have a short shelf life (perishable goods);
      3. are delivered in sealed packaging, which was opened after delivery, and which cannot be returned due to health protection or hygiene reasons (hygienically sealed goods);
      4. have prices that depend on fluctuations in the financial market beyond the Seller’s control, which may occur before the withdrawal deadline.
  9. Chapter 9.Complaints
    1. The Seller is obligated to deliver Products to the customer in conformity with the Agreement.
    2. For consumers and Privileged Entrepreneurs, the Seller is liable for the conformity of the Products in accordance with the provisions of the Polish Consumer Rights Act. For all other customers, the Seller’s liability is based on the provisions of the Polish Civil Code.
    3. Complaints may be submitted:
      • by email to: shop@fiberlogy.com, or
      • in writing to the following address: Brzezie 387, 32-014 Brzezie, Poland.
    4. The Seller will review the complaint in the same form in which it was submitted (by email or in writing) within 14 days of receipt.
    5. If the customer is dissatisfied with how the complaint was handled by the Seller, the consumer or Privileged Entrepreneur may (in addition to pursuing a claim in ordinary court proceedings) also use alternative dispute resolution methods.
    6. To do so, the customer may:
      1. contact the Regional Inspector of the Trade Inspection with a request to initiate mediation proceedings to settle the dispute amicably,
      2. seek assistance from the district (municipal) consumer ombudsman or a consumer protection organization,
      3. submit a request to the permanent consumer arbitration court for resolution of a dispute arising from the concluded agreement.
    7. Additional information regarding out-of-court complaint resolution and claims procedures can also be found on the website of the Office of Competition and Consumer Protection: https://polubowne.uokik.gov.pl/.
  10. Chapter 10.Product Reviews
    1. The Store allows customers to post product reviews (hereinafter referred to as "Reviews").
    2. This functionality is available only to customers who have an Account and are logged in.
    3. Reviews submitted by customers must comply with the law as defined by the Digital Services Act (DSA) and align with generally accepted standards of decency. This means that it is prohibited to post Reviews that:
      • are unlawful in nature;
      • violate accepted moral standards, in particular by containing offensive, pornographic, or blasphemous content, or inciting hatred on the basis of race, ethnicity, or religion;
      • infringe upon the rights of others, especially intellectual property rights, personal rights, or privacy;
      • include commercial or advertising content, or concern products other than those offered in the Store.
    4. The Seller and/or a third-party provider of customer satisfaction and feedback tools may moderate Reviews. This means that Reviews that violate these Terms may not be published or may be removed.
    5. If a Review is blocked or removed, the Seller will inform the customer and provide justification. The customer may appeal such a decision in accordance with Chapter 10, point 6 of the Terms.
    6. Appeals regarding Reviews (hereinafter referred to as "Appeals") may be submitted:
      • by email to: shop@fiberlogy.com
      • in writing to: Brzezie 387, 32-014 Brzezie, Poland.
      The Seller will confirm receipt of the Appeal via email without delay (provided the appellant has shared an email address). The Appeal will be reviewed in the same format in which it was submitted (email or written form) within 14 days of receipt.
    7. Any visitor to the Store may submit a notice (hereinafter referred to as a "Notice") to the Seller if they believe a Review posted in the Store contains illegal content within the meaning of the Digital Services Act (DSA) or violates the Terms. Notices should be submitted electronically to: shop@fiberlogy.com.
    8. The Seller will confirm receipt of the Notice electronically without delay. The Notice will be reviewed within 14 days of receipt, along with a justification of the decision. The person submitting the Notice has the right to appeal the Seller’s decision in accordance with Chapter 10, point 6 of the Terms.
    9. If the appellant is dissatisfied with the outcome of their Appeal, they may seek alternative dispute resolution methods as provided under the Digital Services Act (DSA).
    10. The Seller is not liable for Reviews posted in the Store by customers, provided that:
      • the Seller has no knowledge that the Review constitutes illegal content; and
      • the Seller takes immediate action to remove or restrict access to such content once informed, in particular by promptly reviewing Notices.
  11. Chapter 11.Accessibility
    1. This section of the Terms outlines how the Store’s service meets accessibility requirements.
    2. Both the Terms and the Store’s website are made available in electronic form, compatible with assistive technologies.
    3. The information contained in these Terms has been prepared in text formats that allow for use in alternative and assistive communication. They can be read using screen readers and other assistive tools. Appropriate contrast, spacing between letters, lines, and paragraphs, as well as sufficiently large and legible fonts have been used to ensure readability - whether through native display or text enlargement via assistive technologies. The Terms do not contain any essential non-text content.
    4. The information is provided in a way that ensures it is perceivable, operable, understandable, and compatible with various devices and tools.
    5. More information on how the Store’s service complies with accessibility standards can be found in the Accessibility Statement.
  12. Chapter 12.Final Provisions
    1. Polish law shall apply to all agreements concluded in the Store. The agreement is concluded in the Polish language.
    2. Nothing in these Terms shall exclude or in any way limit the rights of consumers (or Privileged Entrepreneurs) arising from applicable laws.
    3. The Seller may amend the Terms at any time. Such changes will apply to orders placed after the updated Terms are published. In the case of (i) previously concluded contracts for the provision of digital or electronic services, or (ii) customers who have an Account in the Store - the customer will be informed of the changes to the Terms and of the right to reject the updated content.
    4. These Terms are effective as of August 6, 2025.

Account Terms for the Fiberlogy Store

  1. Chapter 1.General Provisions and Contact with the Seller
    1. These Account Terms ("Account Terms") define the rules and conditions for using a customer account ("Account") in the Fiberlogy online store ("Store").
    2. These Account Terms constitute the terms of an electronic service as defined by the Act on the Provision of Electronic Services. The Account service is an additional and auxiliary service provided alongside the Seller’s primary business activity, i.e., offering customers the opportunity to purchase Products. The Account service is provided free of charge.
    3. The Account Terms supplement the Store Terms. For matters not covered by the Account Terms, the provisions of the Store Terms shall apply.
    4. The Seller’s contact details for matters related to the Account service are the same as for the Store:

  2. Chapter 2.Technical Requirements and Account Service Features
    1. The technical requirements for using the Account service are the same as those required for using the Store and are specified in Chapter 2, point 1 of the Store Terms.
    2. By using the Account, the Store’s customer can:
      1. save and store their personal data (including delivery address) within the Account, allowing future purchases without the need to re-enter address information,
      2. view their order history,
      3. check the status of their current orders.
  3. Chapter 3.Account Service Agreement, Right of Withdrawal, and Account Cancellation
    1. Creating an Account by the customer constitutes the conclusion of a contract for the provision of electronic services for an indefinite period. The customer may cancel their Account at any time without providing a reason. To do so, they must contact the Seller electronically at: shop@fiberlogy.com. The customer also has the statutory right to withdraw from the Account service agreement within 14 days of its conclusion.
  4. Chapter 4.Complaints
    1. For consumers and Privileged Entrepreneurs, the Seller is liable for the conformity of the Account service with the agreement, in accordance with the provisions of the Polish Consumer Rights Act. For other customers, the Seller’s liability is governed by the provisions of the Polish Civil Code.
    2. Complaints regarding the Account service may be submitted to the Seller in accordance with the procedure set out in Chapter 9, points 3–5 of the Store Terms.
    3. If the customer is dissatisfied with how the complaint was handled by the Seller, they may also use alternative dispute resolution methods in accordance with the procedure described in Chapter 9, points 6–7 of the Store Terms.
  5. Chapter 5.Personal Data
    1. Full information about the processing of customer personal data, including for the purposes of managing the Account, can be found in the Privacy Policy.
  6. Chapter 6.Amendments to the Account Terms
    1. The Seller may amend these Account Terms under the rules specified in Chapter 12, point 3 of the Store Terms. If the customer does not accept the updated version of the Account Terms, they may terminate the Account service agreement (by contacting the Seller electronically), subject to a 14-day notice period.

Newsletter Terms for the Fiberlogy Store

  1. Chapter 1.General Provisions and Contact with the Seller
    1. These Newsletter Terms ("Newsletter Terms") define the rules and conditions for the provision of the so-called newsletter service by the Seller ("Seller") - the owner of the Fiberlogy online store ("Store").
    2. The newsletter is a series of recurring electronic messages sent by the Seller to the email address of a person who has given appropriate marketing consent ("Subscriber"). These messages primarily contain commercial information regarding the Store and the Seller. They may also include other content related to the Seller’s business, the industry of the Store, or educational content that, in the Seller’s opinion, may be interesting and useful to customers or potential customers of the Store ("Newsletter").
    3. These Newsletter Terms constitute the terms of an electronic service as defined by the Act on the Provision of Electronic Services. The Newsletter service is an additional and auxiliary service provided alongside the Seller’s main business activity, which is offering customers the ability to purchase Products. The Newsletter service is free of charge.
    4. The Newsletter Terms supplement the Store Terms. For matters not covered by the Newsletter Terms, the provisions of the Store Terms shall apply.
    5. The Seller’s contact details for matters related to the Newsletter service are the same as for the Store:

  2. Chapter 2.Technical Requirements and Features of the Newsletter Service
    1. To use the Newsletter service, the following are required:
      1. a computer or other device with software capable of receiving email messages,
      2. an active email address,
      3. access to the Internet.
    2. By subscribing to the Newsletter, the Subscriber will receive email messages from the Seller containing, among other things:
      1. information about new products and promotions in the Store,
      2. discount codes and/or information about other special benefits available to Newsletter subscribers,
      3. other content related to the Store’s and Seller’s activities, the Store’s industry, or educational content that, in the Seller’s opinion, may be interesting and useful to current or potential customers.
    3. The Seller does not guarantee or commit to a specific frequency of Newsletter distribution. The timing of delivery and the content of the commercial information included in the Newsletter are determined solely by the Seller.
  3. Chapter 3.Newsletter Service Agreement, Right of Withdrawal, and Unsubscribing
    1. The Newsletter service agreement may be concluded in the following ways:
      1. when a visitor to the Store fills out the relevant form on the Store’s website, providing their email address to receive commercial information,
      2. during the checkout process - when the customer consents to receive commercial information by ticking the appropriate checkbox.
    2. The Seller may - as an incentive to subscribe - offer potential Subscribers a bonus (gift, so-called lead magnet), such as a discount code, digital content (e.g., a free e-book), or another benefit related to the Store’s activity (e.g., one-time free shipping of Products) ("Bonus"). Information about any Bonus offered in connection with the Newsletter subscription will be presented on the Store’s website.
    3. The Bonus is sent to the Subscriber’s email address provided during subscription, immediately upon conclusion of the Newsletter service agreement. The Bonus is delivered in an appropriate digital form (e.g., a download link for an e-book, a discount code, or a code to be entered at checkout to receive free shipping).
    4. The Newsletter service agreement is concluded for an indefinite period. The Subscriber may unsubscribe from the Newsletter at any time, without providing a reason. To do so, they may:
      1. click the unsubscribe link included in every Newsletter message, or
      2. contact the Seller electronically.
    5. The Subscriber also has the statutory right to withdraw from the Newsletter service agreement within 14 days of its conclusion.
    6. The Seller may discontinue the Newsletter service at any time, and all Subscribers will be informed of such a decision.
    7. If a Subscriber does not open any messages from the Seller within the Newsletter for more than one year, the Seller (after prior notice) will stop providing the Newsletter service to that Subscriber.
  4. Chapter 4.Complaints
    1. For consumers and Privileged Entrepreneurs, the Seller is liable for the conformity of the Newsletter service with the agreement in accordance with the provisions of the Polish Consumer Rights Act. For other customers, the Seller’s liability is based on the provisions of the Polish Civil Code.
    2. Complaints regarding the Newsletter service may be submitted to the Seller in accordance with the procedure set out in Chapter 9, points 3–5 of the Store Terms.
    3. If the Subscriber is dissatisfied with how the complaint was handled by the Seller, they may also use alternative dispute resolution methods, in accordance with the procedure described in Chapter 9, points 6–7 of the Store Terms.
  5. Chapter 5.Personal Data
    1. Full information about the processing of customer personal data, including for the purpose of providing the Newsletter service, can be found in the Privacy Policy.
  6. Chapter 6.Amendments to the Newsletter Terms
    1. The Seller may amend these Newsletter Terms under the rules specified in Chapter 12, point 3 of the Store Terms. If the Subscriber does not accept the updated version of the Newsletter Terms, they may terminate the Newsletter service agreement with 14 days’ notice by contacting the Seller electronically, or with immediate effect, in the manner specified in Chapter 3, point 3 of the Newsletter Terms.
